Summary This position is located in the Corporate Litigation Unit, General Litigation Section, Litigation Branch and is responsible for conducting nationwide litigation involving the FDIC in its corporate capacity and for handling and providing legal advice on other “open bank” related issues. Additional selections may be made from this vacancy announcement to fill identical vacancies that occur subsequent to this announcement. Responsibilities Oversees and/or plans and executes all aspects of assigned federal district court litigation including: (1) preparation of complaints, answers, motions, supporting memoranda, and other pleadings; (2) pre-trial discovery, including depositions, interrogatories, requests for admissions, motions, and responses to requests by opposing parties; and (3) development of overall case strategy and assessment of case impact on national regulatory policies. Responsible for identifying and handling litigation and other challenges to agency action taken pursuant to FDIC regulations or the Federal Deposit Insurance Act. Serves as decisional advisor to the Board of Directors on final orders in administrative enforcement proceedings. Prepares legal briefs, office memoranda, and other documents on legal and litigation issues, including those involving questions of first impression and with conflicting precedent that require extensive research, analyses, and/or unusual ingenuity to resolve. Interprets and applies relevant statutory and regulatory provisions to the development and assessment of policy initiatives. Qualifications Specialized experience must be directly related to the position being filled and is experience gained after issuance of bar membership. This position has a positive education requirement, transcripts must be provided showing degree conferred. Official transcripts must be provided prior to appointment. Education: All attorney and law clerk trainee positions have a minimum education requirement of a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a school accredited by the American Bar Association (ABA). Bar Membership: All attorney positions require current active bar membership (valid license to practice law). Admission to the bar of any state, District of Columbia, any United States territory or Commonwealth, or Federal Court is acceptable. Active Bar membership must be verified prior to appointment. Employees must maintain active bar membership while employed as an attorney with the FDIC. Specialized Experience: Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious/spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the 14 grade level or above in the Federal service. Specialized experience is defined as experience as an attorney conducting, coordinating or managing corporate litigation including matters pursuant to the Administrative Procedure Act. Applicants must have met the qualification requirements (including selective placement factors – if any) for this position within 30 calendar days of the closing date of this announcement. Additional Information Selectee(s) for this position will be required to report to their duty station office at least 1 day per pay period beginning January 2, 2024, and at their supervisor’s direction to support mission and project needs. In person reporting requirements are expected to increase in July 2024. Salary reflects a pay cap for this position of $252,500. The range of pay shown includes base pay plus supplemental locality adjustments. The locality rates for these duty locations range from a low of 33.41% to a high of 40.07%. Pay will vary by grade level and the locality rate for the geographic location where the position is located.
