Summary:
The Manager of Trade Compliance- North America is responsible for overseeing the trade compliance programs for UMBRAGROUP’s North American business operations and will be based out of the Linear Motion LLC Business operations in Saginaw, Michigan. He or she will be responsible for managing the business unit and affiliated repair station business unit compliance programs (Export and Import) in accordance with Linear Motion’s Export/Import Compliance Program. He or she will manage the administration of compliance with the regulations contained within the International Trade and Arms Regulations (ITAR), Export Administration Regulations (EAR), Bureau of Industry and Security (BIS), Foreign Asset Control Regulations (FACR), Office of Foreign Asset Controls (OFAC), Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE or ATF), Customs Border Patrol (CBP), the Department of Justice, and foreign trade compliance as applicable. This position also is the primary point of contact for key customer accounts and is responsible for ensuring the timely and successful delivery of our solutions according to customer needs and objectives.
Essential Duties and Responsibilities:
Create and direct the full implementation of the export control program.
Act as the primary Empowered Official for two facilities
Develop sustainable performance metrics for Trade Compliance
Review complex transactions and determine applicability of internal gate reviews, licenses, exceptions, and exemptions.
Performing customer due diligence and managing various kinds of export compliance issues, such as export license determinations; license applications and approvals
Review and approve export license applications in DECCS and SNAP-R, and work with the business to manage export licenses, agreements, or other authorizations as may be required.
Conduct periodic internal and external compliance assessments to ensure adherence to policies, procedures, and compliance of all activities and transactions with the appropriate import/export laws and recordkeeping.
Develop and deliver a training schedule and program that includes, but is not limited to, business partner due diligence screening, export controls, technology control plans, risk identification, and escalation. Conduct annual awareness and ad hoc tailored training, as required, to include new employees, engineering, logistics, sales, procurement, HR, and other key internal stakeholders at all global locations.
Oversee the review of export/import clauses in Statements of Work and Non-Disclosure Agreements and provide recommendations regarding potential impact to business activity.
Develops and manages comprehensive internal export and import controls to ensure compliance with regulatory agencies in the conduct of international marketing, sales, supply chain and other business activities.
Responsible for maintaining applicable trade compliance records in accordance with regulatory requirements.
Partner with the legal as needed.
Lead in investigations and resolve compliance problems, questions, or complaints.
Requirements
Qualifications:
Due to ITAR regulations, must be a U.S. Person
Bachelor’s Degree with 5+ years of experience. Master’s Degree Preferred.
Expert knowledge of company policies and procedures to resolve routine issues.
Expert knowledge of professional concepts, verbal skills, and writing ability
Expert experience with DDTC, BIS, OFAC, ATF
Expert and proven knowledge of ITAR Chapter 22 part 121-130
Expert and proven knowledge of 600 series of the CCL
Specialize in providing strategic licensing-based business needs, including deemed exports.
Proficient in commodity jurisdiction and classification determination; and making determinations regarding the applicability of formal Commodity Jurisdiction or CCATS submission.
Expert knowledge of US export control laws and regulations
Expert understanding of business unit marketing and contracts practices
Understanding of business unit product lines
Preferred
Expert in making formal presentations, developing, and performing training, and ensuring understanding of legal and procedural requirements at all levels in the business unit.
Experience with interacting with senior level management, government officials, and all levels of employees
Advanced customer service experience in a manufacturing environment, preferably aerospace and defense
Experience with forecasting, establishing, and tracking metrics.
Previous sales and marketing experience
Sales and marketing experience in the aerospace and defense market are highly desirable
Language, Math, and Reasoning Ability:
Ability to read and interpret documents such as safety rules, operating and maintenance instructions, drawings, set-up sheets, travelers, procedure manuals and government regulations.
Computer Skills:
Must be able to use the computer and computer software as required by job.
