Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel’s Office for an exciting and rewarding opportunity as our Staff Attorney Supervisor! This position will provide legal expertise to DCT, with a particular focus on serving the legal needs of the Minnesota Sex Offender Program (MSOP), and, on an as-needed basis, Mental Health and Substance Abuse Treatment Services (MHSATS), Community Based Services (CBS), Ambulatory Care (AC), and Forensic Services (FS).

Primary responsibilities include:

  • Lead and supervise the provision of legal services to the MSOP component of DCT.

  • Support the litigation and policy work of the Agency by conducting legal and policy research to produce written products that collect and apply research to issues concerning the Agency, with particular emphasis on civil commitments and the operation of a state-operated sex offender civil commitment program.

  • Using knowledge of case law, statutes, and how courts apply law to facts, provide legal advice to managers and executives on various topics within the Agency, with a focus on civilly committed individuals and the operation of a state-operated sex offender civil commitment program.

  • Using knowledge of substantive law and policy, provide analysis, legislation drafting, and related writing to support DCT legislative objectives, with particular emphasis on issues connected with civil commitment and MSOP.

  • Monitor litigation involving the MSOP to coordinate litigation-related information and activities in support of favorable outcomes for the Agency, with particular emphasis on litigation connected with MSOP. Supervise Associate General Counsels, who also provides litigation management, coordination, and support.

  • Lead and supervise the development, administration, and implementation of activities, policies, practices, and resources related to the Special Review Board (SRB) and End of Confinement Review Committee (ECRC)

Minimum Qualifications

Demonstrated leadership experience. Leadership experience can include:

  • Experience as a supervisor, lead worker, team lead, project lead;

  • Completion of a State of Minnesota leadership program (e.g. ELI, L4);

  • A paid/unpaid position leading a program or chairing a committee (e.g. ERG) - experience must include:

  • 1+ year of experience identifying issues, goals and strategic actions

  • 100+ hours per year time commitment

AND

Juris Doctorate (JD) degree from an ABA accredited law school;

Current license and in good standing to practice law in Minnesota;

Five (5) years of experience as a practicing attorney within civil commitment, data privacy, healthcare law, administrative law, employment law or a closely related field. Experience must demonstrate the following:

  • Experience with legal research, analysis, and writing.

  • Experience providing legal advice to executive leadership on diverse and complex matters.

  • Experience with the Minnesota Government Data Practices Act and ability to analyze data, determine classification of data, and provide protection of not public data.

  • Experience with litigation practices and techniques, assessment of legal risk, knowledge of negotiation and settlement strategies and techniques, and legal considerations related to settling or compromising lawsuits and claims.

Preferred Qualifications

  • Experience working with the Minnesota Attorney General's Office and/or State government agencies.

  • Demonstrated project management and organizational skills.

  • Experience handling issues related to state and federal laws as they relate to direct care and treatment.
