What You Will Do
The Office of General Counsel is seeking a highly skilled Export Controls Attorney with expertise in U.S. export control regulations, including the Export Administration Regulations (EAR), International Traffic in Arms Regulations (ITAR), and the Atomic Energy Act (AEA). This position will report to the Associate General Counsel for Intellectual Property and Data Security. The ideal candidate will have experience advising on the classification, licensing, and compliance requirements for controlled technologies, including handling classified data and sensitive government information.
This role will involve providing legal guidance on international trade compliance, advising internal stakeholders on regulatory obligations, and implementing risk mitigation strategies to ensure compliance with U.S. and international laws governing the export of defense, dual-use, and nuclear-related items.
What You Need
Minimum Job Requirements:
Extensive experience (minimum 12 years) in providing expert legal counsel on EAR and ITAR compliance related to export-controlled goods, technology, software, and services.
Experience performing legal research necessary to formulate appropriate, practical, and accurate legal advice using both traditional and electronic legal research tools.
Experience drafting, reviewing, analyzing, and providing advice/guidance on legal and institutional documents, related to data and export control.
Experience advising senior and mid-level management concerning legal aspects and consequences of proposed actions and identifying alternative courses of action that will avoid or manage legal risk for the Laboratory while also facilitating mission accomplishment.
Experience engaging in preventive law by anticipating legal issues that may arise and working with clients to develop and implement strategies to manage risk.
Experience developing and conducting training related to export control laws, regulations, and compliance to management and employees, including information on industry practices and applicable regulatory changes.
Experience conducting export control classifications, jurisdiction determinations, and license applications for controlled items.
Experience providing advice related to corporate export compliance policies, procedures, and training programs to ensure adherence to regulatory requirements.
Experience conducting or supporting internal investigations, audits, and risk assessments related to export compliance violations or concerns.
Experience monitoring regulatory updates and provide strategic guidance on changes to export control laws and their impact on business operations.
Experience collaborating with cross-functional teams, including Legal, Compliance, Engineering, Security, and Government Affairs, to address regulatory risks and requirements.
Interface with U.S. government agencies (e.g., BIS, DDTC, DOE, DOD, and NNSA) on export control matters and compliance inquiries.
Experience building productive working relationships and fostering a mutually respectful work environment.
Applicants must have the ability to obtain a "Q" clearance, which usually requires US citizenship. Ability to obtain an SCI may also be required.
Desired Qualifications:
Experience providing expert legal counsel on AEA compliance related to export-controlled goods, technology, software, and services.
Experience advising on classified data handling.
Familiarity with DOE/NNSA regulations and directives pertaining to controlled unclassified information.
Experience with the preparation and submission of export licenses, Technical Assistance Agreements (TAAs), Commodity Jurisdiction (CJ) requests, and Voluntary Self-Disclosures (VSDs) to the Bureau of Industry and Security (BIS), Directorate of Defense Trade Controls (DDTC), and Department of Energy (DOE) as needed.
Experience in representing and/or managing outside counsel in the representation of clients before government agencies or in trials, administrative hearings arbitrations and other legal proceedings pertaining to export control and/or data security matters.
Education/Experience: Position requires a Juris Doctorate from a law school accredited by the American Bar Association and being an active member in good standing of a state bar (any U.S. jurisdiction), and if not licensed in New Mexico, must be qualified to apply for a limited practice license with the State Bar of New Mexico, and minimum of 12 years legal experience.

Work Location: The work location for this position is hybrid and is located in Los Alamos, NM. Hybrid is defined as working partially onsite/partially offsite but within 2 hours ground commute of this location. All work locations are at the discretion of management and can change at any time with appropriate notice.
Position commitment: Regular appointment employees are required to serve a period of continuous service in their current position in order to be eligible to apply for posted jobs throughout the Laboratory. If an employee has not served the time required, they may only apply for Laboratory jobs with the documented approval of their Division Leader. The position commitment for this position is 1 year.

Additional Details
Directive 206.2 - Employment with Triad requires a favorable decision by NNSA indicating employee is suitable under NNSA Supplemental Directive 206.2 (https://directives.nnsa.doe.gov/supplemental-directive/sd-0206-0002) . Please note that this requirement applies only to citizens of the United States. Foreign nationals are subject to a similar requirement under DOE Order 142.3A.
Clearance: Q (Position will be cleared to this level). Selected applicants will be subject to a background investigation conducted by or on behalf of the Federal Government, and must meet eligibility requirements* for access to classified matter. This position requires a Q clearance. and obtaining such clearance requires US Citizenship except in extremely rare circumstances. Dependent upon the position, additional authorization to access classified information may be required, which may or may not be available to dual citizens. Receipt of a Q clearance and additional access authorization ultimately is a decision of the Federal Government and not of Triad.
*Eligibility requirements: To obtain a clearance, an individual must be at least 18 years of age; U.S. citizenship is required except in very limited circumstances. See DOE Order 472.2 (https://www.directives.doe.gov/directives-documents/400-series/0472.2-BOrder-A/@Aimages/file) for additional information.
New-Employment Drug Test: The Laboratory requires successful applicants to complete a new-employment drug test and maintains a substance abuse policy that includes random drug testing. Although New Mexico and other states have legalized the use of marijuana, use and possession of marijuana remain illegal under federal law. A positive drug test for marijuana will result in termination of employment, even if the use was pre-offer.
Regular position: Term status Laboratory employees applying for regular-status positions are converted to regular status.
Internal Applicants: Regular appointment employees who have served the required period of continuous service in their current position are eligible to apply for posted jobs throughout the Laboratory. Incentive Compensation Program: Position is eligible to participate in the Triad Incentive Compensation Program. You must be in an eligible position for a minimum of 3 months, before July 1st and remain in an eligible position as of the end of the fiscal year, September 30th. The annual distribution is prorated based on the number of months in the eligible position.
