Job Summary

Position is responsible for providing professional legal services to the Indianapolis Metropolitan Police Department (IMPD) and serves as an advisor to the Chief Legal Counsel. In the absence of the Chief Legal Counsel this position serves as the legal and policy advisor to the Chief of Police and the Indianapolis Metropolitan Police Department (IMPD)'s Executive Management/Leadership Team.

Position Responsibilities

  • Provide legal advice and opinions to the Chief of Police and IMPD's Executive Management/Leadership Team related to human resources concerns, employment law, internal affairs investigations, criminal investigations, and all other IMPD legal matters.

  • Advise IMPD's Office of Technology in maintaining and evaluating IMPD’s policies and practices regarding technology, including but not limited to data privacy and security; and, drafts and prepares agreements with vendors and research partners as necessary and required.

  • Advise and provide legal assistance to 1500+ IMPD field officers on the resolution of complicated legal issues, both currently underway and preemptively, by identifying potential legal issues, problems and concerns.

  • Counsel, advise and provide legal opinions to the IMPD Board of Captains related to disciplinary matters.

  • Produce written legal opinions, memoranda, legal bulletins, training materials and other documents regarding IMPD operations, policies and procedures to ensure conformity with local, state, and federal laws, rules, and regulations.

  • In conjunction with the Chief Legal Counsel, develop, plan, and assess IMPD policies, procedures and activities relating to the legality of police operations.

  • Performs necessary research relating to police operations, case trends and rulings and advises IMPD Management/Leadership Team of changes that are required to ensure continued compliance with all federal, state and local laws.

  • Primarily responsible for drafting contracts and amendments between IMPD and outside vendors, including license agreements, lease agreements, and other procurement contracts. Coordinate with the Office of Corporation Counsel (OCC) to ensure that contracts are drafted and executed in accordance with City-County procurement policies and best-practice methodologies, City-County ordinance, and state and federal laws.

  • Work with IMPD leadership and OCC to resolve labor contract disputes.

  • Represent IMPD in disciplinary matters before the Civilian Police Merit Board.

  • Represent IMPD in administrative proceedings brought by federal, state, or local bodies, including the Equal Employment Opportunity Commission, Indiana Civil Rights Commission, and Department of Labor.

  • Represent IMPD before the General Orders Board and the Citizens Police Complaint Office.

  • In conjunction with OCC, draft court pleadings, motions, responses, objections, memoranda and correspondence as legal counsel for IMPD in a wide array of legal matters (i.e. internal investigations, civil suits, personnel issues, return of confiscated property, etc.).

  • Respond to subpoenas to IMPD personnel and for the production of IMPD records (i.e. internal investigation files, personnel files, individuals' criminal histories, vehicular crash reports, officer incident reports, etc.).

  • Respond to Public Access Requests directed to IMPD, review and approve disclosure of Body-Worn Camera video and defend IMPD against complaints made to the Public Access Counselor.

  • Coordinate with City Prosecutor on matters related to IMPD's enforcement of municipal ordinances.

  • Advise and assist the IMPD Public Affairs Unit on various issues related to IMPD, including ordinance proposals, pending disciplinary actions, and public records requests.

  • Assist with training and instruction on criminal and administrative law matters to recruits at the IMPD Training Academy.

  • Provide instruction and training to IMPD staff on relevant legal issues.

  • The Corporation Counsel may, by written delegation, authorize the incumbent to enter an appearance and represent, in any court of competent jurisdiction, the Consolidated City of Indianapolis and Marion County or IMPD and/or execute contracts for form and legality under the Revised Code of the City of Indianapolis and Marion County, Sec. 141-204(b).

Qualifications

Doctor of Jurisprudence (J.D.) from an A.B.A. accredited college or university. Current license to practice law in Indiana; license must be active, license must be in good standing, no disciplinary history preferred. Ten or more years’ experience as a practicing attorney. General knowledge of Indiana statutes and local ordinances.

Strong analytical and writing skills. Working familiarity with a variety of computer applications, including the Microsoft Office suite of programs. Excellent organizational, problem solving, decision making, and communication (verbal and written) skills are required.
