Summary THIS IS A NATIONAL GUARD TITLE 32 EXCEPTED SERVICE POSITION. Under this Accelerated-Hire announcement, all applicants who meet the minimum requirements at the grade level for which they apply will be forwarded to the Selecting Official for consideration. This authority authorizes the appointment of Excepted Service T5 NG Employees and T32 Technicians without the requirement to utilize competitive procedures. Applicants must meet all qualification standards to be considered for the position. Responsibilities SUMMARY OF DUTIES: The primary purpose of this position is for Paralegal support within the state/territory Staff Judge Advocate's Office providing ancillary legal research and analysis. Manages the Freedom of Information Act (FOIA), Preventative Law and Alternative Dispute Resolution (ADR) programs in the state/territory. Serves as a point of contact for claims, ethics determinations, legal assistance for Army and Air National Guard personnel and their families, and provides technical legal guidance and support to National Guard unit commanders and their assigned legal personnel. Provides ancillary legal work to state/territory SJA and other assigned Army National Guard (ARNG) and Air National Guard (ANG) attorneys servicing the state/territory National Guard's case load. Provides research, analysis, guidance, and support to administer courts-martial, non-judicial punishment, administrative boards and other legal actions and administrative processes. Manages the Preventative Law Program. Manages the SJA portion of the state/territory Alternative Dispute Resolution (ADR) program. Serves as the primary point of contact for claims. Serves as the primary point of contact for ethical determinations. Reviews changes in regulations on the Freedom of Information Act and updates and advises other legal personnel and field staff of changes. Performs other duties as assigned. GENERAL EXPERIENCE: Experience, education or training that demonstrates the ability to analyze the legal impact of legislative developments and administrate and judicial decisions, opinions, rulings and determinations on agency programs; conduct research for the preparation of legal opinions on matters of interest to the agency. Practical knowledge and use of basic legal principles and concepts to interpret and apply or explain to others the application of a body of law, regulations, precedents, and practices covering one or more recurring types of legal actions encountered in an agency. SPECIALIZED EXPERIENCE: 1-year specialized experience, education, or training equivalent to at least the next lower grade level in the formal and informal rules of evidence and skill necessary to evaluate the adequacy and/or admissibility of evidence, to request additional data or further investigation, when needed, or to develop narrative or graphic exhibits to support specified legal arguments and coordinate actions with other federal agencies or state and local jurisdictions that have closely related responsibilities. MILITARY TECHNICIAN COMPATIBILITY POSITION: Prior to placement in this position, the selected applicant must be assigned to an appropriate military position and must meet the definition of a dual status technician in accordance with 32 U S C 709. CONDTIONS OF EMPLOYMENT: 1. Must be able to obtain and maintain the appropriate security clearance of the position. 2. This position is covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the Gun Control Act (Lautenberg Amendment) of 1968. An individual convicted of a qualifying crime of domestic violence may not perform the duties of this position. 3. Irregular and/or overtime (compensatory) hours may be required to support operational requirements or contingencies or may be required to work hours outside of the normal duty day. 5. Situations of inversion of military rank are not permitted, i.e., a military technician may not be militarily senior to his or her full-time supervisor. b. Authorization for payment of PCS expenses will be granted only after determination is made that payment is in the best interest of the Hawaii National Guard. c. In addition to your application, documents of last performance appraisal, past civilian performance, letter of recommendations, and or military performance may be submitted. d. Candidates may be screened and evaluated on military attributes directly related to the compatible military position required to be assigned into, such as, but not limited to, military bearing, leadership, or ability to work with others (teamwork) in a military environment. e. Cost of living allowances (COLA) vary from island to island. COLA is subject to change without notice. k. Current T32 Technicians who have permanent tenure will occupy this position as a Temporary Promotion Year to Year not to exceed 5 years. Temporary promotion may be converted to a Permanent Promotion without further competition if the position becomes available. Selectee may return to his/her former graded position when the Temporary Promotion is no longer needed and may be effected at any time without adverse action procedures. l. T5 Employees with permanent tenure will lose their permanent status if selected and will be converted to T5/T32 Indefinite. If selected Indefinite tenure appointments may be separated when their services are no longer needed or when funding is no longer available via a 30-day termination notice. Indefinite tenure appointments will be eligible for health and life insurance coverage and will be covered under a retirement system. m. New Indefinite appointments may acquire permanent status depending upon future force structure requirements; indefinite tenure appointments do not serve a trial period. Indefinite tenure appointments may be separated when their services are no longer needed or when funding is no longer available via a 30-day termination notice. Indefinite tenure appointments will be eligible for health and life insurance coverage and will be covered under a retirement system.
