The DAS Legal Default Specialist deals primarily with consumer accounts involved in the legal collections process. A high level of communication between outside business contacts in other professions occurs on a daily basis. Knowledge of the legal system, bankruptcy legal code, foreclosure process, probate process, repossession and replevin action and Fair Debt Collection Practices Act (FDCPA), are essential in this position.

ESSENTIAL DUTIES and RESPONSIBILITIES included the following. Other duties may be assigned.

1. Analyze consumer outstanding debt and determine whether the case will be worked in house or referred to an attorney.

2. Assess the intentions of consumers in bankruptcy, utilizing previous experience, bankruptcy law, and bank policy to determine what the next course of action should be. Decide whether to prepare and send a reaffirmation agreement for signature, instruct an attorney to file for relief from stay or co-debtor stay, or object to debtors proposed plan based on case analysis.

3. Code all bankruptcy loans according to policies and procedures to assure correct reporting to the credit bureau and ensure compliance with the federal stay barring collection actions.

4. Prepare and maintain reports as needed for accounts in bankruptcy, foreclosure, probate, and replevin action.

5. Process legal invoices for payment and add fees to loan when applicable. File Proof of Claim with the Bankruptcy Trustees Office, when applicable.

6. Receive and apply Chapter 13 disbursements monthly. Follow-up on all accounts on a monthly basis from bankruptcy trustee and decide if alternative action is needed.

7. Review real estate secured loans and determine if foreclosure or charge off is needed. Assign appropriate counsel for legal accounts.

8. Prepare real estate bids and provide bid information to assigned counsel.

9. Service probate cases involving Arvest customers. Recommend appropriate action needed to the DAS Legal Default Manager.

10. Stay abreast of legal processes, i.e., replevins, repossessions, foreclosures, and probate.

11. Understand and comply with bank policy, laws, regulations, and the bank\'s BSA/AML Program, as applicable to your job duties. This includes but is not limited to; complete compliance training and adhere to internal procedures and controls; report any known violations of compliance policy, laws, or regulations and report any suspicious customer and/or account activity.
