Description of Job

The Work Unit :

The Administrative Services Program (ASP) exists to provide a wide spectrum of services and support to the management and staff of the Air Pollution Control Division (APCD). The ASP consists of the Fiscal and Contracts Services Unit (FCSU), Records Management, and the Business Services Unit (BSU). The services include, but are not limited to, legislative, policy development, accounting, contract management, budgeting, grants/funds management, revenue billing/invoicing, financial reporting, time and effort reporting, supplies/equipment/services procurement, personnel administration, office management (e.g., space allocation, telephone and fax services, office supplies), human resources, and coordination of information technology services.

What you will be doing

This position is a permanent, full-time position that is responsible for negotiating, writing and maintaining the Air Pollution Control Division’s (APCD) contracts, purchase orders and procurement. This position is responsible for abiding by Department, Division, and Unit processes and procedures within the APCD related to contracts and procurement.

Job Duties:

Division Contracts Development

This position develops all APCD contracts, purchase orders, and general accounting encumbrances. The Position reviews contracts for compliance with APCD, CDPHE, state and federal requirements. Coordinates contract workflow for the division in a proactive manner to ensure the division has appropriate solicitations and contract documents in place as required by the Procurement Code and Fiscal Rule and to meet the division business needs Works with the Contracts and Procurement work lead, the APCD Fiscal Services Supervisor (FSS) and Administrative Services Manager (ASM) to obtain necessary funding in support of contracts, purchase orders, and procurements. Develops program-specific solutions to complex procurement and contracting needs. Resolves issues and discrepancies as appropriate with the FSS and department contracts administrator for recommended action as needed.

Prioritizes, evaluates, and reviews statements of work to ensure compliance with the SOW development process and program requirements. Provides and develops guidance to division staff regarding necessary changes, improvements, and additions to the SOW for contracts.

Advises and educates users on contracting procedures. Advises and educates programs on the most efficient contract template to utilize for their particular project. Provides technical assistance in writing statements of work and contract budgets. Develops guidance and educational materials provided and presented to program staff. Develops educational materials on evolving Contracts and Procurement legislation.

Advises ASM, FSS and/or program managers of contractual and/or budgetary discrepancies; analyzes, evaluates and recommends solutions and/or reallocation of funds as appropriate. Resolves discrepancies with outside vendors and internal personnel. Provides monthly financial reports to the FSS for all contracts.

Position remains current and familiar with changing state and federal expectations, grant focus areas and requirements and ensures incorporation of directives into statements of work and contractual agreements while coordinating alignment with State directives, expectations and requirements.

Position is responsible for APCD contracts, purchase orders, and general accounting encumbrances entries into the statewide financial system, Colorado Operations Resource Engine (CORE).

Procurement

Coordinates solicitation workflow for the division in a proactive manner to ensure division has appropriate solicitations in place as required by Procurement Code and Fiscal Rule and to meet the division business needs.

Identifies appropriate procurement and vendor selection method for proposed projects in coordination with purchasing and contracts unit by analyzing proposed budgets, statements of work, and all associated requirements and policies on a per project basis. Reviews and analyzes work plans and associated requests for proposals, determines compliance with state and federal requirements. Investigates statutory violations.

Position receives and/or creates drafts of solicitation documents. Reviews and edits as necessary to assure specifications and statements of work are adequate, accurate and consistent with law, rule, policy, and sound business decision-making. This includes use of alternative or expanded language to improve meaning.

Coordinates and negotiates interactions between division level fiscal and programmatic decision-makers and the Contract/Purchasing Unit (final approver), throughout vendor selection and procurement process regarding the development and implementation of associated process, statements of work/budgets development, vendor selection methods, and other associated procurement commitment documentation.

Maintains knowledge of and interprets State and Departmental purchasing and contracting laws, rules, policies, procedures, guidelines and best practices to include those issued by the State Purchasing and Contracts Office, State Controller's Office.

Determines appropriate formats and content, execution time lines, budget, and supporting documentation requirements and/or waivers. Provides technical assistance to Division Grant and Program Managers and external Contractors and Stakeholders on State and Department procurement rules, procedures and timelines.

Advises and educates users on procurement procedures. Develops educational materials on evolving Procurement legislation. Educates Contracts staff on identifying, adhering to, and monitoring purchasing thresholds throughout the life of the Contract.

CORE Entries

Creates new fiscal year/ contract performance period encumbrances in CORE. Reviews CORE, CORE reports, and division internal reports.

Other Duties as Assigned

Attends meetings, serves on task forces or teams, completes projects, and performs other duties as assigned by the supervisor.

Minimum Qualifications, Substitutions, Conditions of Employment & Appeal Rights

MINIMUM QUALIFICATIONS:

An applicant may meet the minimum qualifications for this job in one of two ways: They may qualify through their work experience alone or through a combination of education and work experience.

Experience Only:

Six (6) years of experience in professional level environmental air pollution control experience.

OR

Education and Experience:

A combination of related education and/or relevant experience in professional level environmental air pollution control experience and/or degree in environmental science or studies, chemistry, biology or related fields, engineering, environmental policy or law equal to six (6) years.

PREFERRED QUALIFICATIONS

In addition to the minimum requirements, the successful candidate in this position will have the following experience:

  • Experience interpreting or implementing state and/or federal air quality regulations

  • Experience providing compliance assistance

  • Experience communicating both orally and in writing to a wide range of partners

  • Excellent oral and written communication skills

  • Excellent interpersonal skills

  • Ability to multi-task and work independently

  • Strong data analytical, inductive and deductive reasoning skills

  • Experience performing regulatory inspections to determine compliance with Colorado & Federal air pollution control regulations.

  • Experience working at or inspecting refineries, chemical plants, or natural gas processing plants.

  • Experience inspecting Clean Air Act major emission sources to determine compliance with Operating Permits, Consent Decrees, or other compliance orders.

  • Experience communicating complex technical and regulatory findings verbally and in written reports and defending alleged violations and settlement negotiations.

  • Experience evaluating compliance with continuous emission monitoring equipment and data acquisition systems.

  • TRAVEL: Inspections are conducted across the state, so inspectors may stay overnight for efficiency when active in areas of the state that are far from home.

  • SPECIAL QUALIFICATIONS: Colorado Driver’s License in order to legally operate state fleet vehicles and independently access remote locations throughout Colorado to perform assigned job duties
