Position Summary
Experienced and knowledgeable attorney with in-depth knowledge concerning a broad range of state energy regulatory policy issues. Substantial state utility commission experience, energy policy, customer choice, power siting, and renewable energy experience preferred, with a preference for litigation and oral advocacy experience. Will be responsible for providing legal guidance requiring independent judgment and frequent client contact. Provide high quality and timely legal advice and counsel in support of the business unit or legal practice for all electric and natural gas utility matters, with a special emphasis on issues associated with customer choice, energy transition, and siting. Attorney also assigned responsibility for routine legal matters including, but not limited to ratemaking, PURPA policy issues, prudence determinations, affiliate issues, and other issues germane to an investor-owned regulated utility. Develop relationships with clients to ensure client communication and responsiveness. Demonstrate responsiveness and teamwork within the legal department.
Associate General Counsel - Ohio Regulatory works under the direction of a Deputy General Counsel on defined legal problems or legal problems lacking clear precedent which require the application of specialized expertise and business acumen. The incumbent’s primary duties will be to work on administrative litigation matters in Ohio and possibly Kentucky concerning general energy policy issues and to otherwise addresses legal and regulatory problems and concerns arising out of the day-to-day functions of Duke Energy. Works on non-routine matters which require a broad and thorough understanding of the Duke Energy’s business and industry.
Perform complex assignments, using legal research, analytical and writing skills, involving both state and federal law.
Provide legal advice to management regarding matters of some complexity which may have a material dollar impact on business operations.
Research legal principles and precedents, consult with outside counsel, draft and execute legal documents, and gather relevant case information using multiple sources and methods.
Handles administrative litigation matters and conducts hearings including presentation of witnesses and cross examination.
Coordinates and collaborates on regulatory matters that have various areas of overlap within the business.
Advice and counsel on compliance matters relevant to regulatory matters.
Oversee and manage routine regulatory reporting and compliance filings.
Responsibilities
Provides counsel to electric and natural gas management and represent Duke Energy in administrative litigation in regulatory proceedings involving electric and natural gas energy matters, as well as pricing, rates, customers service matters, transmission, distribution planning, electric and natural gas siting, and system operations, tariffs, territorial assignment, compliance matters, regulatory accounting and other federal and state law compliance matters which require quick study and a desire to expand existing knowledge in regulated energy industry.
Responsible for regulatory proceedings, the defense or prosecution of Appellate Cases as assigned and numerous rulemakings, interventions in other related matters.
Represents Duke Energy in regulatory matters requiring specialized expertise in state regulatory proceedings and a thorough understanding of the regulatory concerns facing Duke Energy in order to negotiate the best possible outcomes for Duke Energy’s business and its customers.

Contributes to projects of significant importance to the Company from a risk, monetary or policy perspective. Works with and at the direction of the leader in the department.
Consults with team and Deputy General Counsel on legal issues with significant value, or which may have economic, political or media implications for the Company.
Provides quality, timely legal advice to management for day-to-day matters and major ongoing legal projects that fall within the incumbent’s realm of expertise.
Researches and drafts legal documents, such as contracts, corporate governance documents or other legal documents, and assists with negotiations.
Works to establish professional relationships within the Company related to areas of subject matter expertise.
Monitors legal developments, legislation and pending legislation promulgated by the Federal government and the states in which the company does business, to assess and advise implementation of and compliance with new laws, regulations. Stays abreast of interpretations adversely affecting current methods of operations. Maintains job-related technical knowledge and skills, and in-depth knowledge of issues relating to the utility industry.
Leads and/or serves on committees, special projects, or other assignments as directed to further departmental goals.
Working Conditions
Must live in the Columbus Ohio area and able to commute to our Columbus office and occasionally to our Cincinnati, Ohio headquarters.
Ability to travel interstate to company headquarters in Charlotte NC, or other locations in the US 2 to 3 times per year
Hybrid – Work will be performed from both remote and onsite locations after the onboarding period. It is expected that the employee will average at least 3 days per week in office. Hybrid employees should live within a reasonable commute to the designated Duke Energy facility.
Required/Basic Qualifications
Doctor of Jurisprudence degree (JD) from an accredited law school
Minimum of seven (7) or more years of experience practicing law
Licensed to practice law in Ohio or Licensed to practice in any state in the US and eligible for admission under Ohio bar rules
Desired Qualifications
Ohio regulatory/agency experience
Litigation experience
Understanding of emerging energy issues
Litigation experience, including experience drafting legal pleadings, motions, and briefs.
Previous experience in rate cases or rider proceedings before the Public Utilities Commission of Ohio, or similar state commission
Experience interacting with state agencies on compliance matters
Experience with state regulation and government affairs for public utility companies
Basic understanding of electricity production
Understanding of electric and natural gas utility industry and challenges
Experience with utility rate-making
Experience with Accounting
Experience with environmental issues
Previous experience handling investigations or litigation matters
Experience with tax issues
Proven effective verbal communication, research, and writing skills
Sound judgment and decision-making
Ability to manage multiple complex matters simultaneously
Ability to take initiative and work independently
Ability to comprehend and analyze technical issues associated with regulatory compliance
Experience analyzing complex matters and reducing them to manageable products and communications
