Job Description
Summary
Mallinckrodt is seeking a patent agent with 3+ years of legal experience. Preferably this experience includes in-house experience in the life sciences field. This position will be responsible for the intellectual property needs within both the Specialty Brands and Specialty Generics business units, including providing strategic counseling, performing freedom-to operate analysis, managing patent preparation/prosecution and post-grant activities, performing due diligence, and supporting IP litigation.
Essential Functions
Interact with R&D and project teams to identity patentable inventions and execute patent strategies
Provide direction to outside counsel on patent filings and prosecution matters globally
Provide landscape analyses and related support to R&D
Provide patentability, freedom-to-operate, and related opinions in support of R&D activities and business development activities
Provide IP diligence for M&A and related activities
Monitor third party patent activity in areas of interest
Assisting in offensive and defensive patent challenges in global patent offices
Assist commercial attorneys with IP elements of agreements
Assist in technical support of IP litigation
Manage or participate in projects impacting the IP team, the Legal Department, or Mallinckrodt
Minimum Requirements
Education/Experience:
Bachelor’s degree required with a focus in chemical or biological sciences or engineering preferred. Advanced degree preferred.
Admitted to practice before the U.S. Patent and Trademark Office preferred.
3+ years of law firm and/or in-house pharmaceutical/life science experience
Skills/Qualifications:
Experience with global patent filing strategies
Experience working as or with an outside counsel.
Experience with U.S. and European patent office proceedings
Strong oral and written communication skills
Strong interpersonal skills
Strong analytical skills and attention to detail
Strong organizational skills, including the ability to manage and drive projects
Strong business acumen including ability to integrate IP and business risks and considerations
Exposure/experience with the Hatch-Waxman Act, the BPCIA, and patent litigation generally.
Organizational Relationship/Scope:

This position will work within the Legal function and have professional interaction with senior leaders across multiple functions. This position will also represent the company to external regulatory agencies.
Working Conditions:
This position is located in Bridgewater, New Jersey under a hybrid working model.
