The Texas Board of Architectural Examiners is a multi-profession regulatory agency that oversees the examination, registration, and professional regulation of architects, interior designers, and landscape architects. The successful candidate will primarily work within the agencys disciplinary processes, which protect the public health, safety, and welfare by taking enforcement action in cases involving violations of the Boards laws and rules by licensees and other regulated persons. The successful candidate will collaborate with the Enforcement Division to develop case files, consider agreed dispositions, and represent the agency in hearings before the State Office of Administrative Hearings (SOAH). This work involves organizing and planning legal activities, coordinating the preparation of legal documents, participating in administrative hearings, interpreting laws and regulations, and rendering legal advice and counsel. The successful candidate may supervise the work of others and will work under limited supervision, with considerable latitude for the use of initiative and independent judgment. 1. Enforces agency regulatory provisions and prosecutes violations by coordinating and representing the agency in hearings before SOAH. 2. Organizes and coordinates legal activities. 3. Manages a caseload of pending complaints, which could include advising the enforcement division in developing admissible evidence, interviewing witnesses, drafting and negotiating settlement offers, and administering a busy litigation calendar. 4. Coordinates and assists in the preparation of documents for litigation, including formal charges and notices of hearing, subpoenas, discovery requests and responses, motions, briefs, etc. 5. Presents settlement agreements and SOAH Proposals for Decision to the Board for review and approval. 6. Advises staff and the public on legal matters and on the interpretation and application of agency regulations and state and federal laws. 7. Coordinates, advises, and assists in the preparation of legal opinions, briefs, proposals, and reports. 8. Depending on litigation workload, may assist the General Counsel in rulemaking, contract management, and/or formulating, coordinating, and establishing policies and procedures. 9. May supervise work of others. 10. Performs related work as assigned. Qualifications: Minimum Qualifications: 1. Graduation from an accredited law school with a Juris Doctor (JD) degree. 2. Member in good standing with the State Bar of Texas. 3. Two years of experience in litigation. Preferred Qualifications: 1. Experience at a regulatory state agency. 2. Experience in enforcement cases. 3. Experience against represented parties in trial settings before SOAH or other courts. Skill in legal research, writing, and analysis; in the use of a computer and applicable software; in using reasoning and logic; in identifying and solving complex problems; in prioritizing workloads; and in using judgment to select courses of action. 3. Ability to conduct hearings, to prepare opinions and briefs, to prepare cases for trial, to conduct research, to summarize findings, to interpret and apply laws, to use legal reference materi ls, to communicate effectively, and to supervise the work of others. While performing the duties of this job, the employee is constantly exposed to computer and telephone equipment, telephone and printer noise, busy environment with many interruptions and is occasionally exposed to outside weather conditions. The noise level is usually moderate. Some travel will be required for outreach programs, meetings, and training. Work Schedule Work hours Monday through Friday from 8:00 a.m. 5:00 pm. May be required to work additional hours including evenings or weekends. Telework may be permitted after an introductory period.
