Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, if the candidate meets the below NY HELPS minimum qualifications.NY HELPS Non-Competitive Qualifications:Position may be filled at the Senior Attorney level or one of the Assistant Attorney traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.Assistant Attorney 1 (Grade 18): Law school graduation and/or eligibility for NYS Bar Admission.Assistant Attorney 2 (Grade 20): Admission to NYS BarAssistant Attorney 3 (Grade 22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experienceSenior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experienceNOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. The preferred candidate must have strong legal skills, be able to adhere to strict deadlines, have demonstrated ethical and intuitive decision-making, have a working familiarity with public health issues, be able to work as a member of a team, possess excellent oral and written communication skills, and should have the ability to manage a varied and demanding caseload and meet regular deadlines. Duties Description Under the supervision of the Associate Attorney, provide legal counsel and guidance to the Office, including: • Reviewing agency requests for new technology, goods, and services, negotiating terms and conditions with vendors when necessary;• Working with OSC’s Information Security team to ensure the security, integrity, and availability of OSC data, in the context of new procurements;• Reviewing and revising solicitation documents (e.g., IFBs, RFPs, RFIs);• Drafting contractual terms for inclusion in solicitations;• Attending and participating in vendor conferences and roundtables;• Advising in the review and response to vendor solicitation questions;• Advising on the review of proposals and bids submitted to ensure responsiveness;• Negotiating final contracts with awardees; and• Advising on contract management issues, including acceptable performance, deliverables, warranties, termination, transition to new contractor, etc.Procurement and contracting issues may include cyber security requirements; information technology hardware, software and consulting; insurance; research and database services; minority- and women-owned business enterprises; service-disabled veteran-owned businesses; preferred sources; and training.Miscellaneous • Work with the Associate Attorney and other Unit staff to provide guidance on Freedom of Information Law (FOIL) matters.• Perform research and provide legal counsel related to the College Savings Program, Privacy, Copyright, and other related topics.

Additional Comments Desired Competencies • Graduate of an ABA-accredited law school and either admitted to practice law in New York State or scheduled to sit for the New York State bar examination.• Interest in procurement, contracting and cyber security.• Excellent written and verbal communication skills, including legal research abilities.• Ability to organize large volumes of factual and legal data into clear and logical sequencesTelecommuting: The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s duties and work performance are aligned with telecommuting they may be allowed to do so. Upon approval to telecommute, OSC employees may telecommute up to 5 days per pay period.
