STARTING SALARY: $100,890
JOB SUMMARY:The Legal Department attorneys report to the General Counsel. The attorneys perform similar tasks with varying degrees of discretion and independence depending upon experience and performance level.
ESSENTIAL JOB FUNCTIONS:1. All aspects of preparation for and conduct of litigation in numerous forums, including Federal District Court in all four districts; State Courts throughout New York State; administrative agencies including Public Employment Relations Board, National Labor Relations Board, NYS Industrial Board of Appeals, NYS DHR, EEOC, Child Abuse Registry; contract grievances and disciplinary arbitration under various state and local collective bargaining agreements; disciplinary hearings pursuant to statutory procedures; administrative expunction hearings.The above duties involve responsibility for all phases of litigation, including legal research; analysis of legal issues; investigation and assessment of facts; development of case strategy; conduct of depositions and other discovery; motion practice; witness preparation; handling of evidentiary issues; handling of settlement negotiations; mediation or other dispute resolution; research for and preparation of legal briefs and memoranda and conduct of trials, hearings, and motion practice in the courtroom or hearing room.2. All aspects of preparation for and conduct of appellate practice in numerous forums, including federal appellate court (Second Circuit, Court of Appeals); state appellate court in the four departments of the Appellate Division; New York State Court of Appeals; appellate level of Public Employment Relations Board; appellate level of National Labor Relations Board.3. Knowledge of many diverse areas of substantive law, including State Civil Service Law, Title VII, Federal and State Constitution, FMLA, Taylor Law, FLSA, ADA, ADEA, FOIL, OSHA, NYS Labor Law, RSSL, NFPC. In addition, individual attorneys have responsibilities in designated specialty areas.4. Knowledge of the internal procedures of all forums in which the attorneys practice, including trial level and appellate procedure, local rules of the Federal Courts in all the districts, Federal Rules of Civil Procedure, and rules of administrative forums.5. Attendance at and service to the CSEA Statewide Election Committee. Responsibilities include providing consultation and legal advice, and drafting decisions, ensuring compliance with federal laws applying to union elections, representation of union before DOL on election matters.6. Serve as ongoing resource for CSEA staff, local and unit officers and activists, in response to inquiries involving federal and state law, interpretation of state and local collective bargaining agreements, etc.; legal research in connection with responding to such inquiries; also, provide early intervention assistance as appropriate to resolve matters without need for litigation. These responsibilities are carried out both in response to written inquiries, and also on a daily, extemporaneous basis via the attorney-of-the-day service.7. On-site assistance to field staff on a biweekly basis at the Regional Offices, for purpose of analyzing merits of potential legal matters and identifying necessary investigation for the pursuit of such matters; may include meeting with potential witnesses or other affected persons as part of such assessment.8. Legal research, evaluation and analysis in connection with recommendations to Standing Legal Committee in response to various requests for Legal Assistance.9. Prepare and present training to staff, CSEA officers and members, at Annual Delegates Meetings, Workshops, LRS trainings, etc., on varied substantive and procedural matters; also, prepare resource materials for staff, officers, and members, including the Advocate publication.10. Serve as part of legal team for various CSEA governance functions, as assigned by General Counsel, including provision of oral and written research, document creation, guidance, follow-up, and training for related committees and entities.11. Assist CSEA Communications staff in presentation of legal cases and issues to the media.12. Upon assignment from Counsel, any other duties or tasks as necessary.
MINIMUM QUALIFICATIONS:Juris Doctorate from ABA accredited Law School plus specific legal experience or evidenced interest and competency in labor law, employment law, litigation, or an appropriate combination thereof. Admission to NYS Bar within 15 months of employment with CSEA. Continued maintenance of good standing in all courts of admission.
